Ship With WIS Terms and Conditions

Effective Date: the date this document is first published on the Ship With WIS website. The owner sets and publishes the effective date and version from the admin dashboard.

These Terms and Conditions govern the use of services provided by Ship With WIS. They are written to be read together with any service-specific quotation, invoice, warehouse rule, carrier condition, Privacy Notice or written instruction supplied to the customer.

1. Acceptance of Terms

By creating an account, submitting a package or shopping request, paying for a service or otherwise using Ship With WIS, the customer confirms that they have read, understood and agreed to these Terms. The website acceptance box must be selected before registration or a service request is completed.

Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded under Jamaican law.

2. Scope of Services

Ship With WIS provides courier and logistics coordination services for packages moving primarily from the United States to Jamaica. Services may include air-freight coordination, use of a designated warehouse address, package receiving and handling, customer notification, pickup coordination, islandwide delivery through third-party couriers and assisted online shopping when separately accepted.

Third-party delivery fees, customs charges, special-handling charges and optional services are payable by the customer unless a written quotation states otherwise. Ship With WIS may modify, temporarily suspend or discontinue a service for safety, legal, operational or commercial reasons, but will take reasonable steps to notify affected customers and address services already paid for.

3. Customer Responsibilities

Customers must provide accurate names, contact details, package descriptions, values, invoices, tracking numbers and delivery information. Customers must use the correct warehouse address and customer identifier supplied to them and must not send items for another person without authorization.

The customer is responsible for checking vendor order details, sizes, quantities, colours, compatibility and delivery estimates before placing an order. Any cost caused by incorrect or incomplete customer information may be charged to the customer when permitted by law.

4. Shipping Schedule and Estimated Times

Shipments are generally scheduled up to three times per week, depending on warehouse and carrier operations. All departure, arrival, customs-clearance, pickup and delivery times are estimates rather than guarantees.

Delays may result from customs processing, inspections, carrier changes, weather, vendor delays, incomplete documentation, public holidays, emergencies or other circumstances outside the reasonable control of Ship With WIS. Customers will be updated when reliable information is available.

5. Service Area and Delivery

Ship With WIS serves customers across Jamaica. Pickup options and delivery availability will be displayed or communicated for each shipment. Islandwide delivery may be completed by Knutsford Express or another approved independent delivery partner and will normally attract a separate fee. For Knutsford Express delivery, the customer pays the applicable Knutsford Express fee upon delivery.

Responsibility for final delivery transfers to the third-party carrier when that carrier accepts the package, subject to applicable law and the carrier’s own terms. Customers must provide a secure, accessible delivery location and an available recipient.

6. Care, Risk and Liability

Ship With WIS will exercise reasonable care while a package is within its custody or direct control. Responsibility generally begins when the designated warehouse records the package as received with verifiable proof and ends when the customer, an authorized recipient or an independent delivery partner accepts the package.

Ship With WIS is not responsible for vendor errors, undisclosed defects, incorrect customer information, packages lost or misdelivered before verified warehouse receipt, customs actions or loss, damage or delay caused solely by an independent carrier or another third party outside Ship With WIS’s reasonable control.

Any claim will be investigated using warehouse scans, photographs, invoices, tracking records and handover evidence. Any compensation will be determined in accordance with applicable law and any valid warehouse, carrier or insurance terms. Nothing in this section excludes liability for Ship With WIS’s own negligence or any liability that cannot legally be excluded.

7. Packaging, Fragile and High-Value Items

Vendors and customers are responsible for suitable packaging. Ship With WIS is not responsible for damage caused solely by inadequate vendor or customer packaging that was not reasonably detectable before shipment.

Electronics, glass, liquids, cosmetics and other fragile or high-value items require additional care and may be accepted only under special-handling or insurance conditions. Customers should contact Ship With WIS before shipping such items and should keep all invoices and photographs.

8. Prohibited and Restricted Items

Customers must ensure that every shipment complies with Jamaican law, United States law, carrier rules, aviation rules and customs requirements. Ship With WIS may refuse, hold, return, surrender or arrange lawful disposal of an item that is prohibited, unsafe, inaccurately declared or rejected by a carrier or authority.

Prohibited or restricted items include, without limitation:

  • Illegal drugs, controlled substances or unlawfully obtained goods
  • Firearms, ammunition, weapons, explosives or hazardous materials
  • Flammable, corrosive, toxic, pressurized or otherwise dangerous materials
  • Counterfeit or unauthorized replica goods
  • Obscene or unlawful materials
  • Perishable food, live animals, cash, cheques or negotiable instruments
  • Any item prohibited or restricted by customs, aviation, postal, warehouse or carrier rules

The customer is responsible for losses, lawful disposal costs, fines or penalties resulting from an item the customer knowingly or negligently misdeclared, subject to applicable law.

9. Customs, Duties and Government Charges

Customers must provide truthful descriptions and values and are responsible for customs duties, taxes, permits, declarations and government charges unless a written quotation clearly includes them.

Ship With WIS cannot guarantee customs release and is not responsible for inspections, seizures, penalties or delays caused by customs authorities, except to the extent that Ship With WIS’s own incorrect action caused the issue.

10. Assisted Online Shopping

This section applies only when Ship With WIS expressly agrees to purchase an item for a customer. The customer must pay the quoted purchase price, service fee and any required deposit before the order is placed and must approve the product link, description, size, colour, quantity, seller and total.

Once an order is placed, vendor cancellation, return, refund, warranty and exchange rules apply. Ship With WIS will provide reasonable assistance but cannot guarantee a vendor’s decision. A refund received from a vendor will be returned to the customer after any lawful, disclosed, non-recoverable cost is deducted. Ship With WIS remains responsible for its own ordering error.

11. Prices and Payment

Current shipping rates and applicable fees will be displayed on the website or provided in writing. Charges may be based on billable weight, package dimensions, customs assessment, special handling, storage and delivery. The customer must be told about material charges before payment whenever reasonably possible.

Accepted payment methods may include bank transfer, cash and approved online-payment options. Ship With WIS charges must be settled before package release or delivery unless Ship With WIS agrees otherwise in writing. The Knutsford Express delivery fee is separate and is paid by the customer upon delivery.

Amounts already earned for a completed service or non-recoverable third-party cost may be non-refundable. Unearned amounts will be refunded when required by law or where Ship With WIS cancels or cannot provide the paid service, less only reasonable, disclosed costs that have already been incurred.

12. Claims and Complaints

Customers should inspect packages promptly. A claim should be submitted in writing through the official email address or claim form listed on the Ship With WIS website within 72 hours after collection, delivery or notice of the issue. Customers should provide the tracking number, invoice, photographs, packaging and a clear description of the problem.

A WhatsApp message may be used to alert customer support, but the claim is not complete until the requested written information and supporting evidence are received. Ship With WIS will acknowledge and investigate claims within a reasonable time. This operational timeframe does not remove any longer right that the customer may have under applicable law.

13. Storage and Uncollected Packages

Customers should collect or arrange delivery within three calendar days after notification that a package is available. A storage fee of J$200 per day may apply from the fourth day when the fee was disclosed to the customer.

If a package remains uncollected for 15 days, Ship With WIS may issue a final written notice and take reasonable steps permitted by law to recover storage and administrative costs, arrange return or dispose of the package where return is not reasonably possible. The customer’s ownership and consumer rights will be respected, and disposal will not occur where prohibited by law or while a timely, genuine dispute is being investigated.

14. Cancellations

A cancellation should be requested at least 24 hours before a scheduled service when applicable. A reasonable cancellation charge may apply only where it reflects an actual or reasonably estimated cost already incurred and was disclosed before the customer confirmed the service.

Ship With WIS may cancel or refuse a service for safety, illegality, non-payment, abusive conduct, inaccurate declarations or operational necessity. Where Ship With WIS cancels a paid service without customer fault, the unearned amount will be refunded, less any lawful, disclosed third-party cost already incurred.

15. Changes to These Terms

Ship With WIS may update these Terms. The revised version and effective date will be posted on the website. Material changes will apply to future services and will not remove rights already earned under an existing transaction unless the law requires otherwise. Continued use after the effective date constitutes acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Jamaica. Customers should first submit complaints through the official Ship With WIS claims process so the matter can be investigated. Nothing in these Terms prevents either party from using any lawful complaint, mediation, tribunal or court process, including contacting Jamaica’s Consumer Affairs Commission where applicable.

17. Entire Agreement and Severability

These Terms, together with any written service quotation, invoice, policy or accepted instruction, form the agreement between Ship With WIS and the customer. If a court or tribunal finds one provision unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
